Construction Agreement - Short Form

A construction agreement is the legal instrument by which a person, the project owner, retains the services of a specialised contractor to complete work that is a part of a construction project (for example: plumbing, soundproofing, welding, isolating, electricity, carpentry, masonry, etc.). It is not an employment agreement because the contractor acts independently from the project owner.

The contractor must prove that they have the knowledge or required experience in managing a construction business and realizing construction projects. This type of specialised contractor is different from a professional service provider, which is covered in our professional services agreement template (F03200).

A construction project requires significant planning efforts in order to respect the budget and timeframe. Completing a building construction project also requires putting in place risk management strategies with regard to the design and completion phases of such a project. As such, this template contains all the main elements of the legal and economic framework relating to a construciton agreement.

Construction Agreement - Short Form

This template can be used when a project owner wishes to retain a specialized contractor, without creating an employment relationship. It is important to note, however, that the Courts could find that an employment relationship exists, if the provider is subordinate to the project owner. More precisely, if the provider only works for the project owner, if the project owner controls the way the provider must work and provides the necessary tools, we recommend using an employment agreement (see templates C2300 or C02305) to define the terms of the business relationship between the parties.
