Trademark Assignment Agreement

This agreement governs the sale and assignment of the ownership of a trademark to an assignee, whether or not the trademark is registered. The Canada Trade-marks Act provides (under section 48) that a trademark is transferable in respect of all or some of the goods or services with which it has been used.

Trademark Assignment Agreement

We recommend this template to any person who wants to buy or sell a trademark without the intervention of a trademark agent.

In addition to signing a trademark assignment agreement, the parties must also send a copy of their agreement to the Trade-marks Office along with the contact information of the new owner of the trademark. The parties must also pay the required fees and ensure that the name of the owner of the trademark is updated in the trademark register at the CIPO.
