A Chief Financial Officer (CFO) plans, organizes, directs and supervises all activities related to the financial management and accounting of a business. Given the importance of the CFO's role, the legal relationship between the CFO and the corporation should not be disregarded. The improper management of such a crucial position can have serious consequences, such as the possible bankruptcy of the business.
This letter of hire template provides the main elements to define the rights and obligations of the CFO and the corporation; however, it is presented in a much shorter form than the related Employment Agreement template (C03350).
Letter of Hire - Chief Financial Officer
We recommend using this letter of hire when the terms of employment are very straightforward (in contrast to template C03350). In some cases, the letter of hire may also serve as a promise to hire when an employment agreement will be signed at a later date.
It should be noted that in Canada there are no legal provisions requiring an employer and an employee to sign a formal employment agreement. A simple verbal agreement is sufficient to establish the employment relationship. However, a verbal agreement may fail to clearly define the rights and obligations of the parties or provide the legal framework to meet their specific needs.
