Offer to Lease
Unless a letter of intent has been sent, the offer to lease is the first written document between the parties regarding the rental of premises. Consequently, this is the document that establishes the contractual relationship and the key terms of the lease to be entered into by the parties.
In some cases, the parties may decide that, once accepted, the offer to lease will constitute the actual lease agreement. If so, it is preferable to prepare a very thorough offer containing all elements of the lease, to ensure that the relationship between the parties is clearly set out in writing. For this purpose, it is best to refer to our general lease agreement (template E02200) and our lease agreement for a shopping centre (template E03200).

We recommend using this document to lay a solid foundation for the purpose of negotiating a commercial lease. If detailed enough, the parties may decide to use offer to lease as the actual lease.
