Lease Assignment Agreement

The assignment of the lease does not create a new lease. The tenant assigns its lease to an assignee, meaning that the assignee is substituted as tenant and the rights and obligations under the lease are transferred to it.

This agreement has the advantage of being simpler than a sublease; but this does not mean that it is free from difficulties. This template sets out the principal terms for this type of transaction.

Lease Assignment Agreement

This sublease agreement template can be used when a tenant (lessee) wishes to terminate a lease, in whole or in part, before its expiry, as the lessor will nevertheless be entitled to continue collecting rent until the end of the lease. The tenant assigns his or her lease to an assignee. This operates a substitution of tenant and transfers from one to the other all rights and obligations arising from the lease.
